3. App and Website Terms

You may use My Theory Aid App if you are at least 17 years old or if you are 13 years of age or older, and this agreement is entered into on your behalf by a person of the majority who is capable of entering into such agreements and making them binding upon you (“Guardian”). In the second case, your Guardian agrees to be bound by these terms and must ensure that you comply with them.

If a third party uses your account on your behalf, you and the third party agree to these terms using My Theory Aid.

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the Service or any contact on the website through which the service is provided without express written permission from us.

The headings in this agreement are included for convenience only and will not limit or affect these terms.

5.1. Prices and Payment

The My Theory Aid service prices are quoted on our website in pound sterling. While we strive for accuracy, some prices on the website may need to be corrected. We will verify prices as part of our sales procedures to ensure that the correct cost is stated when you pay for the service.

Moje Solutions is based in the United Kingdom, so prices on the website include all applicable value-added taxes.

Prices for the service may change at any time, but changes will not affect contracts that have come into force.

Payment must be made upon submission of your order. We may withhold the service and/or cancel the contract between us if the price is not received in full in cleared funds.

Payment for the service must be made using any method detailed on the website.

Our product range consists of digital goods only, which are available for purchase through the App Store and Google Play store. Upon purchasing our My Theory Aid app, you will be able to access all the premium features of the app.

By purchasing our app, you agree that it is for personal, non-commercial use only. Exploiting the app for any commercial purpose is strictly forbidden.

Please check that your device meets the minimum system requirements as displayed on the app store before downloading the app.
We reserve the right but are not obligated to limit the sales of our app to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

We reserve the right to limit the quantities of any products or services we offer. We have made every effort to display as accurately as possible app information and pricing, which are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue the app at any time.

7. Your Warranties

You warrant to us that:

• (a) you are legally capable of entering into binding contracts and have full authority, power,
  and capacity to agree to these terms of service;
• (b) the information provided in your order is accurate and complete;
• (c) you will be able to download and use the app on your device.

Using our My Theory Aid app, you confirm that you comply with these warranties.

8. Risk and Licence

Grant of the total premium licence of the app will only pass to you upon the later of:

• (a) the successful download of the app; and
• (b) receipt by us of full payment of all sums due in respect of the app (including delivery charges where relevant). We will be entitled to recover payment for the app even where ownership has not passed to you.

All app sales are handled directly with the relevant App Store – iTunes, Google Play, and Amazon. Please refer to your receipt from the appropriate app store regarding their refund policy.

We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these terms of service at any time – providing such action does not serve to reduce the guarantees benefiting you under these terms of service.

Each contract under these terms of service is made for the benefit of the parties and is not intended to benefit or be enforceable by any other person. The right of the parties to terminate, rescind, or agree to any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.

Subject to these terms, they contain the entire agreement and understanding of the parties concerning the purchase of My Theory Aid app and supersede all previous agreements and understandings between the parties concerning the purchase of My Theory Aid app. Each  party acknowledges that no representations not expressly contained in these terms of service have been made by or on behalf of the other party concerning the purchased licence of the My Theory Aid app.

These terms of service will be governed by and construed following English law. The courts of England and Wales will have non-exclusive jurisdiction to adjudicate any dispute arising under or concerning these terms of service.

11. Errors, Inaccuracies, and Omissions

We have done our best for the app’s accuracy in terms of translation. However, there may be information on the app or service that contains typographical errors, inaccuracies, or omissions that may relate to My Theory Aid Translations, product descriptions, pricing, promotions, and offers. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the app, service or on any related website is inaccurate at any time.

Our product, My Theory Aid includes the Driver and Vehicle Standard Agency (DVSA) revision question bank. Other contents, such as translated material, graphics, and other intellectual property and elements incorporated into our app, are Moje Solutions’ and our partners’ property. This property is protected by international copyright, trademark, and other laws.

Our app and its content may not be copied, reproduced, changed, disassembled, decompiled, or distributed in any way without our written consent. Without our express written consent, you may not use our trademarks, logos, or other proprietary information, including images and text. Any unauthorized use of the material may violate copyright, trademark, and other laws.

14. Trademarks

• (a) My Theory Aid, Moje Solutions and our logo are trademarks belonging to us. We do not permit the use of these trademarks, and such use may constitute an infringement of our rights.
• (b) The other registered and unregistered trademarks or service marks on our app, including DVSA’s, are the property of their respective owners. Unless stated otherwise, we do not endorse
  and are not affiliated with any of the holders of any such rights, and as such, we cannot grant any license to exercise such rights.

You may not use any trademark, service mark, trade name, the logo of ours or any third party without our prior written consent. Any unauthorized use of the material may violate copyright, trademark, and other laws.

15. Contributions

Suppose you submit any “Content” of any type, including reviews, commentary, ideas or suggestions, whether solicited or not. In that case, you agree to grant Moje Solutions a license to use, modify, and delete such content for whatever purposes we see fit without your express
permission.

You must ensure that you are the owner or creator of such content or have received permission from the owner or creator to submit it to us. By submitting any content to us, you represent and warrant that you have the right to do so and that such content does not infringe or violate any rights of any third party, including but not limited to any intellectual property rights, rights of privacy or publicity, or any other rights. We reserve the right to delete, remove or not post any submitted content that we find violating these terms or that we see otherwise objectionable.

16. Disclaimer

Access and use of our app are at your own risk. To the extent permitted by law, the app is provided on an “as is” and “as available” basis. No representations, warranties or conditions of any kind are provided with our app, even if they may be implied in other areas of our app. We do not guarantee error-free, virus-free or secure operation and access to our app. We encourage all purchases to be downloaded and backed up immediately by you, and we do not guarantee that your purchases will be available for download permanently.

We do not guarantee that our app will always be available or that your use will be uninterrupted or error-free. My Theory Aid, Moje Solutions and our providers will not be liable to you or any other person for any indirect, incidental, consequential, special, punitive or exemplary damages arising from, connected with, or related to the use of the My Theory Aid app or these terms of service, including but not limited to loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability (whether in contract, tort, strict liability or any other theory of law or equity), regardless of any fault or wrongdoing by us or any person for whom we are responsible, and even if we have been advised of the possibility of such damages being incurred.

Any translation errors are unintentional, and Moje Solutions is not liable for any damages or loss caused by such errors. If you find any translation inaccuracies, feel free to contact us.

18. Warranty Disclaimers and Limitations

My Theory Aid is provided “as is” without express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement. In no event shall Moje Solutions be liable for any damages of any kind, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages arising out of or in connection with the use or inability to use My Theory Aid. Furthermore, Moje Solutions shall not be held liable for any malfunction, defects, errors, or inaccuracies in the app or any loss or damage of any kind that may result from the use of the app or its content.
